Licensing, Can It be Done?

You may be interested to note that licensing can take place any time after the application is filed. Some manufacturers, distributors or wholesalers might prefer to license an invention while it is still in the patent pending stage, but my experience with inventors is that most persons or entities they approach for licensing would rather wait to see if the patent issues.

Should another party become interested in licensing or purchasing your intellectual property, I can assist you in the drafting of a licensing agreement, or filing an assignment.   Licensing agreements may be either exclusive or non-exclusive.  Each has advantages as well as disadvantages.  The cost of drafting a licensing agreement may be in the range of $1,500 to $2,500.   Each licensing agreement is case specific, and must be tailored so as to be acceptable by all parties. It is best to receive counsel before determining which licensing agreement would be in your best interest.

An assignment of patent rights is a sale of patent rights.  My fee for the assignment and recordation of the assignment with the Patent Office is $160 per assignment, which includes the assignment fee payable to the Patent Office.
